a quick question.
I have an ex-boyfriend who got booted out the army last year for a charge of ABH, this was after it went to court and the army said he could stay in, two weeks later they discharged him :evil: .
Just found out he been in a poilce cell since Mon morn, and is being charged with 3 counts of ABH. Will his record from the army be used agianst him and make his sentance longer (he faces up to 5 years at the moment), or will it not be used as he is now a civvy?! I know it may sound like a daft question but im not to good with law details! I did jury service, sat there asked who the judge was!haha!joke! :lol:

Seriously though, will it be used against him?, and is there anything I can do to help? His making it worse for himself at the moment as he wants to take the fall for his two mates as well, as they have partners and kids and he doesnt think its fair to take them away from that!!

Does he have any previous convictions? Any previous convictions can be used as evidence of bad charachter. However, if he doesn't have any they can't be used obviously.

Generally military service goes for a defendant as evidence of good character. Any charges he had in the Army, a civil court wont know about, unless the Army sought to bring civil charges as well as military charges.

ahh then he may well be up shit creek with out a paddle!! :( He got put away in Colchester Military prison for 18 months I think, for beating a guy , he was ment to be in Canada at the time went AWOL to Germany to find the guy. thats the short version of that story. his also abit of a :drinking: this makes him very violent and agressive :bad-words: .
I tried alsorts to help him out when we were together, and im still trying now :( .

It doesnt look good for him tho does it?! :cry:

ABH and AWOL!!!!
As you say it does not bode well for his future in the military.
He would be lucky to get a job as a bouncer at Mothercare.

The only thing the defence might be able to use on his behalf is that he has already lost his job, it's not much but it might just take some of the sting out of the sentence

Quite frankly, he sounds exactly the type of person who SHOULD be locked up in prison, never mind looking for ways to keep him out of there :roll:

hahaha. he was on the army boxing team, but got taken off for his fighting skills being "to agressive". he has had a lot go on, i know its no excuse, but i also know that he is an awesome guy, he just needs help!! and contrary to opinion a spell in the nick will not do him any good at all, make him worse!!

so how long do you think he'll get?! :-? got to face up to him going down I guess?! just found out his also doing community service for another offence a few months back! :o

why colchester though?! he is'nt in the army any more, and the offence he comited was outside the army!! and what is DD?!

It won't be Colchester, cos he's a civvy, and he's already been discharged, they can't do that twice!

Doesn't matter which prision he goes to, sounds like he should certinatly be in one though.
