Criminal Record.....

Post by MH1982 »

So i recently passed selection and now got my date for phase 1 in the next few months. Now as per usual things dont run so smoothly and ive recently been talking to the police who have asked me to come to the station so i can be arrested on suspicion of assault. where am i going to stand with getting in the army if i get charged with this? (the incident has nothing to do with me but thats another story!) can anybody give me an idea as ive kept myself away from this kind of bullshit for years now and just as things seem to be going ok this kinda crap happens.

Just be honest and you need to let those involved with your recruitment process ASAP.
Your date maybe rescheduled until all is resolved.

End of the day the fact that they are asking you nicely to come in for a chat rather than going knocking on your door says it may be something over nothing. drunken lads scrapping over a handbag for example?? Only you know whether or not its a fair kop - if you gave him a kicking over nowt then expect the worse, if not the police will suss it out and decide it may/maynot be worth further queries. In my own experience I chose not to inform afco I was in the sh*t - which was like playing with a loaded gun with hindsight. luckily for me even tho I gave him a kicking my story outweighed his and I got away with it. A point to note was that the police and prosecution thought it more in the publics interest for me to go away and begin my recruit training in the services 'the forces will sort you out lad'.

im now on bail until may. some lad sayin i hit him which caused him to fall into the road!! complete bollocks but his bird and mates sayin i did it. might have to go fight my case in court. no cctv evidence so basically its his word against mine. he bit my mates ear off and now saying self defence coz i hit him 1st. oh and his bird happens to be my ex! the police were saying to me tho that an assault conviction wont affect going into the army. is that right??

Your application to join will be put on hold until this has been resolved and thats a fact!
If its a fine, then you cannot join until the fine is paid. If its community service the same applies. However if its a suspended sentence then until that sentence is spent you will be barred from entry.
Now although you can join with up to three unspent conviction, you may find that your recruiter tells you to come back in 12 months or so, the Army can pick and choose at the momnet and although it may be your first conviction it is after all a conviction for assault!!

It will depend on how long you have to wait,if its over 12 months then yes its start from square one Im afraid.
Barb and Medical are only valid for 12 months!

the fact he has bitten someones ear off may just swing it in your favour. i'll assume your friend is pressing charges and rightly so due to losing part of his ear. Then laddo is looking for an excuse to justify it and you have come up as the person to blame it all on - I wouldnt be suprised if he and his cronies had sat down and had a good think about how to get themselves out of the sh*t. Did you hit him first? What did you say to the police? sometimes giving the police too much information which you consider to be honest and what in fact had happened can be detrimental - did you make use of the duty solicitor? I can imagine it will amount to nothing as its your word against theirs and as there is a lack of evidence it may not be deemed worth a day in court. It depends how aggresively your mate wants justice for his ear. I imagine the lad will deny it till blue in the face and make you out to be the main culprit. Keep your hands in your pockets next time!

this is pretty much the same as what what i have been thinking. he is going to try anything to get away with it..... No i never hit him 1st, told the police it was complete sh!t what they are saying.
and surely if i was the person that hit him first then it would be me missing a chunk of my ear, or at least it would have been me he would have been trying to fight????

Sounds like your friends case is the strongest out of the lot of you all. If your and him are telling the truth and it all ties up I dont think you will have much to worry about. I personally and Id imagine most, dont think much already of the guy biting chunks out of ears.I also imagine so too would the police, it gives a clue as to the nature of the person willing to do it i.e violent. Having said that I dont know the facts but on paper 'jaws' is up sh*t creek.
