I have something which was 'liberated' at the end of WW2 by Gran Dad.
Now it seems this item is quite sort after being a original one off.
What are the legal implications of spoils of war ?

Dear Borg,

The legal machinations governing such matters are both complex and, in certain areas, vague. Much depends on what it is that your grandfather took, the circumstances under which he acquired said article (i.e. pick it up in a field, from a house, off a corpse etc.), the status of the previous owners and if your grandfather is still alive.

In general Borg, war booty is illegal and classed as theft. HOWEVER ... there is much leaway for battlefield souvenirs. Of course if your grandad pinched a priceless work of art or other national treasures, they would in all likelihood be returned to their legal owners. I would definitely recommend you seek advice before you think of selling it in a public forum, perhaps the British Legion may be able to help with legal guidance?

its a bronze plaque of Mussolini that was 'removed' from a monument at Milan Navel College in 1945, its signed and about the size of a dinner plate

Hello Borg,

I don't think you will have a problem, though I wouldn't make a loud noise about how it was acquired. I you are considering selling it then check with your solicitor or an auction house first.
