hi guys,

ive posted this in the RM general discussion so if here or there isnt where it should be then i guess the mods will soon shift it.
anyway, im joining the marines and am waiting for a PRMC date. last night i was arrested and fined £80 for fighting... my only concern is that this wont effect my future with the marines, the police officers reassured me that it wouldnt but my dad (an ex RM) has told me that they do checks all the way through training and will boot you off even over the slightest thing.
so basically, is there anyone that can reassure me that i wont get binned before ive even begun? if not then should i tell my local AFCO about it ASAP?
ANY HELP would be much appreciated,

jonno

Jonno, you’re fcuked mate, so it`s the Foreign Legion for you :o

Rehabilitation of Offenders Act probably applies here.
You were a naughty boy, you were sentenced to a fine.
You paid the fine.
Therefore the sentence is “spent”
That means it`s finished with. Tell the AFCO, he’ll say the same thing son
Let this be a lesson to you, behave yourself in future.
99.999% need not apply. 8)
And yer Dad will never be Ex RM, there is no such thing.
Only Serving or Former
Ask him if you don`t believe me :P

Hi mate,
under the rehabilitation of offenders act 1974 a fine (including fines upon children or young persons but ordered to be paid by their parents or guardians) is not deemed "spent" for 5 years from the date of conviction.

This may not affect your application as I have also being fined not so long ago (different offence to yours though) and I have had no problems.
As already stated though speak to your afco.

What was the actual charge?

Unlikely to affect your application, but if you don't tell them, they will find out sooner or later and then you'll be in a lot more shit, INTEGRITY my friend is a valued principle in the Corps.

hi guys,

thanks alot for the replies.

druadan: i was arrested for affray but was charged for 'using words/conduct likely to cause harassment, alarm or distress' (section 4), but infact, i was holding my drunken mate back who was trying to start on 3 blokes who had done nothing to him... its just my luck that my good nature gets me trouble.
im going to be taking legal action against the fine.

thanks again,

jonno

Without knowing the letter of the law, sounds like a very insignificant charge, and shouldn't affect your application if it's the only thing on your record. AFCO will be able to advise further, but I know lads with worse charges against them than that, tho I couldn't tell you if they joined with the charges or picked them up in the Corps.

well, i went in to my AFCO today and told them about what had happened and theyve taken a copy of the fine and have said that im still accepted onto the october 3rd - 6th PRMC but i will need to REALLY impresses them whilst im down there. worst case scenario now is that the navy will put me on a "rehab period" of up to 5 years... all this just for trying to break up a scrap.
cheers guys,

I suppose that you have learned your lesson -

AND - my pension being what it is you can come over here
and slap me for eighty quid, while you're on your Cold Weather stuff !

:)

Good luck with it all.

I was convicted at court a month back for driving without the appropriate car insurance and was fined £250.

Will this affect my application in to the marines and do I have to declare this as unspent, even though I have paid it?

Yes, declare it.
It's not worth risking anything coming back to bite you on the arse, not to mention not doing your integrity any favours!!

Declare it, shouldn't affect you. I was on a drink drive ban when I applied, slightly longer security clearance but that was it. Guess what I do now? D3 :o

Erm, Is this jonno or Ajax who also got fined £80 for slappy handbags? And the police are now RM recruitment experts?

It's so sad I don't know whether to laugh or cry. :-?

sisyphus - im not to sure what you meant by your post but anyway... i was fined £80 which i have paid, but is "no admission of guilt".
i believe that ajax was also fined £80 in a completely seperate incident. i gave the guy my advice on his thread regarding his conviction but does not mean that i approve of what he did.
